Bill Summary
Under existing law, there is no mechanism for review of presidential executive orders by the state
This bill would authorize the Legislative Council to review a presidential executive order and recommend to the Attorney General and the Governor that the order be examined to determine its constitutionality
This bill would also prohibit state agencies and political subdivisions and their officials and employees from implementing a presidential executive order that restricts individual rights or that relates to epidemics, the regulation of natural resources, the regulation of the agricultural industry, the regulation of land use, the regulation of the financial sector through the imposition of environmental, social, or governance standards, or the regulation of the right to keep and bear arms and is determined by the Attorney General to be unconstitutional
Relating to presidential executive orders; to authorize the Legislative Council to review a presidential executive order and recommend to the Attorney General and the Governor that the order be examined to determine its constitutionality; and prohibit state agencies and political subdivisions and their officials and employees from implementing an executive order that restricts individual rights or that relates to certain topics and is determined by the Attorney General to be unconstitutional.
