Bill Summary
Under existing law, a licensee of the Alcoholic Beverage Control Board may permit a customer to remove from the premises an unsealed bottle of wine provided the bottle of wine is either recorked or resealed in a bag under certain conditions. The existing law also provides that a bottle of wine recorked or resealed in compliance with the law is not considered open for the purpose of the law prohibiting an open container of alcoholic beverages in a motor vehicle
This bill would delete the language in the existing law providing that a bottle of wine recorked or resealed in compliance with the law is not considered open and would specifically provide how recorked or resealed bottles of wine may be transported in a motor vehicle considering the type of storage space in the vehicle
To amend Section 28-3A-20.1 of the Code of Alabama 1975, authorizing certain licensees of the Alcoholic Beverage Control Board to remove a recorked or resealed bottle of wine from the licensed premises; to delete certain language in the law providing that the recorked or resealed bottle would not be considered an open container of alcoholic beverages; and to specifically provide for the manner of transportation of a recorked or resealed bottle of wine in a motor vehicle considering the type of storage space in the vehicle.
