Bill Summary
Under existing law, a student's driver's license generally can be suspended for withdrawing from school before graduating or for possessing a pistol on school grounds or on a school bus. School officials do not have authority to initiate the suspension of a student's driver's license for other misconduct or disruptive behavior in the classroom
This bill would provide for suspension within 10 days, in lieu of the current 30 days, following notice of adjudication of possessing a pistol at school or on a school bus
This bill would require the Department of Public Safety, upon recommendation of a school principal, to suspend a student's driver's license for serious misconduct or a pattern of misconduct or disruptive behavior in school. The principal would have to certify to the department compliance with all the due process requirements of the local school system's disciplinary policies and procedures
To amend Section 16-28-40, Code of Alabama 1975, relating to the suspension of a student's driver's license for withdrawal from school or possession of a pistol at school, to provide further for the date of suspension of a student convicted of possession of a pistol at a school or on a school bus, and to provide for the suspension of a driver's license for a student who engages in serious misconduct or a pattern of misconduct or disruptive behavior at school or on a school bus.
